Terms & Conditions - Rental Agreement
This contract is binding upon initial payment. By submitting payment for this reservation, you certify that you are at least 25 years of age and you are legally competent to enter into this agreement, including the Release, Waiver, Assumption, and Indemnity provisions contained herein. You agree that this agreement is fully effective and shall be effective and binding upon you, the members of your family, spouse, guests, heirs, next of kin, executors, administrators, assigns, or anyone else authorized to act on my behalf or on behalf of my estate and shall be governed by the laws of the State of Florida. You agree that you have read, understood, and agree to adhere and be bound by these terms and conditions of this rental agreement, making it a legal binding contract. “You”, “your”, and “guest” means the individual signing and submitting payment, and all occupants of the property during the stay, and “we”, “us”, “our”, “manager”, and “Endless Summer on 30A” means Endless Summer on 30A, LLC. “Owner” means the owner of the rental property. “Unit” or “home” means the property rented by the guest. You acknowledge receipt of, and have read, and understand, and agree to all terms and conditions stated in this Terms & Conditions - Rental Agreement & Policies and you shall be responsible for all damage, breakage, and/or loss to the premises, except normal wear and tear and unavoidable casualties (deemed by Owners & Managers of the Property), which may result from occupancy. You agree that all pipes, wires, glass, plumbing, furniture, household contents, etc. will be in the same condition as at the beginning of your stay. Any problems that occur during your stay will be reported immediately to the Property Manager. I certify that I will be held responsible for the care of this property being rented. I accept full responsibility for damage or extra cleaning charges, should they be discovered during or after departure.
1. Check-In/Check-Out: You are not allowed to enter the Property until all housekeeping, maintenance, and inspections have been completed. Failure to do so could result in an additional charge. We will contact you if your rental is ready earlier than the 4pm CST check in time. Check out time is at 9:00am CST or 10:00am CST depending on which property you are staying at. Please refer to your check in instructions for the proper check out time.
2. Payment Terms: An advanced reservation payment equal to 50% of the total booking charges is due at the time of reservation. The remainder 50% is due 30 days prior to the check-in date and will automatically be charged using the same credit card you used to make your first reservation payment. Please contact us prior to the 30 days prior payment if you would like to use a different form of payment. Failure of said payments when due may result in cancellation of this Agreement.
3. Cancellation: Reservations may be cancelled by notifying Endless Summer on 30A, LLC in writing. 50% refund for cancellations more than 30 days before check-in. 100% refund for cancellations more than 60 days before check-in date minus the administration fee.
4. Pets: Pets are strictly forbidden. Having a pet at or in a property is grounds for immediate eviction without a refund, along with an additional charge of $2000.00. If a guest needs a service animal, please contact us directly at 850-520-0234 so that we can accommodate your needs.
5. No Smoking: Smoking is not permitted at any of our properties, including patios and balconies. Guests will be financially responsible for any damages, extra cleaning charges, and an additional $1000.00 charge due to smoking. (The act of smoking includes the use of the following: tobacco cigarettes, electronic cigarettes, cigars, and pipes.)
6. Maximum Number of Guests: Guests who exceed the maximum occupancy are subject to immediate eviction and forfeiture of all payments previously made.
7. Age Requirements: Guests must be 25 years of age to rent this property and must stay with other occupants in the unit or home at all times. They must also provide proof of age if requested. Guests who violate this agreement will be immediately evicted and forfeit all payments previously made.
8. Housekeeping: The vacation rental will be cleaned prior to your arrival and after your departure. You will be responsible for cleaning the home or unit during your stay and for leaving the unit in good condition at check out. We ask that you respect the property and remember that you are staying in someone’s home. If the home or unit is found abnormally dirty at check-out, an additional cleaning charge could occur. Laundry facilities are provided in the rental property, unless otherwise noted. Bed linens and bath towels will be furnished. Lost or damaged linens will be charged accordingly. The property will also be stocked with an initial supply of trash can liners, paper towels, toilet paper, bath soap, dishwasher soap, laundry detergent, and fabric softener.
9. Beach Towels: PLEASE BRING YOUR OWN BEACH TOWELS! We do not permit towels, sheets, blankets, or furniture to be removed from the property.
10. Maintenance Issues: During your stay, promptly report any maintenance issues to our office at 850-520-0234. Please do not leave doors or windows open while the A/C or heaters are in use. Endless Summer on 30A, LLC staff may enter the property to respond to any maintenance and/or housekeeping issues during your stay. (If A/C condenser coils freeze up due to windows or doors being open you will be charged the service call and the A/C unit needs to be shut down for a 24hr. period to resolve the issue.)
11. Personal Property: Owner and/or Property Managers are not liable or responsible for any acts of theft, vandalism, or other damages to any personal property, or for personal items left by guests in the property at departure.
12. Good Neighbor: We respectfully request that you remember you are staying in someone’s home during your vacation. Please treat it with care and leave it in good condition at check out and conduct yourself in a manner that is non-offensive to the neighbors.
13. Damages: The property will be left in the same good and habitable condition as found upon arrival. Any damages or noticeable conditions found upon arrival will be reported to the Property Manager within one (1) hour of occupancy. You understand the property will be inspected prior to your arrival and after your departure.
You agree and give Endless Summer on 30A, LLC permission to charge the credit card on file for any damages, items missing, or additional cleaning for abnormally dirty unit/home that exceeds the security deposit or over the policy limit or not covered by the damage protection. There will be no additional charges if the following provisions are met. No damage is done to the property or its contents beyond normal wear and tear. No excessive cleaning is required. All keys, fobs, gate passes, and wristbands are left in the unit/home, and all entry/exit doors of the unit/home are left locked.
14. Hurricane/Severe Weather: Refunds for cancellations or shortened stays due to hurricanes, tropical storms, other inclement weather, or Acts of God will not be issued by Endless Summer on 30A, LLC under any circumstances. We recommend that all guests purchase adequate travel protection insurance.
15. Construction/Noise/Property for Sale during Stay: Properties adjacent to or close by the property being rented by the guest may have ongoing construction. Acceptable noise levels and start and finishing times are governed by local ordinances and/or the homeowners association. We are not liable for any disturbances or interruption that may occur during your stay that is out of our control. In the event a property is on the real estate market, we may need to show the property during your stay. We will provide the guests occupying the property 24 hours’ notice before scheduling any showings.
16. Departure: Prior to vacating the property, guests are responsible to remove all trash and put in garbage containers supplied. Any furniture that was moved during your visit must be put back in its original position. Dirty towels are to be left on the bathroom shower floors or in the bathtub. Please leave linens on the beds and do not make the beds that have been slept in. Reset thermostats to 74 degrees cool in hotter months and 64 degrees heat in colder months. Please check the property for your personal belongings before departing.
17. Liability: Owners and Property Managers shall not be liable to Guest, Guest’s guests, or any other person for any injury, including death, loss, or damage to any person or property on or about the premises. Guests shall hold Owner and Property Managers harmless and indemnified from and against all loss, injury, or damage caused by the use, misuse, or abuse of any part of the property, elevator, swimming pool, parking area, beach, and from or against any omission, neglect, or default of guests, guests guest, or invites. The Manager is also not responsible for any acts of theft, vandalism, or other damages to any personal property of the guests or for personal items left by the guests in the unit/home at departure.
18. Subletting: This property my not be sublet and is for the Guest’s use only. Your reservation is not transferable to any other party.
19. Property Rules & Regulations: Please observe all property rules including Operational & Safety Instructions for the elevator (instructions are in elevator), pool rules (rules are on fence in pool area), failure to comply can result in eviction and forfeiture of all payments previously made along with any additional charges for damages.
20. Swimming Pool: In consideration for receiving access and/or permission to use the swimming pool at your rental property or otherwise made available to you as an amenity in conjunction of your rental by Endless Summer on 30A, LLC, you herby release, waive, discharge, and covenant not to sue, and agree to indemnify and hold harmless for any and all purposes the Management Parties and Owners from any and all liabilities, claims, demands, responsibilities, causes of action or injury, including death, that may be sustained by you or your guests, involving or arising from you or your guests use of the pool and its facilities, or other actions or omissions related thereto, whether caused by the Manager Parties, Owners, or negligence.
You agree that you are fully aware that there are risks involved with use of the pool, including but not limited to possible physical injury and loss of life and you choose to voluntarily use the pool facilities with full knowledge that the use of the pool facilities may be hazardous to you and your guests.
YOU VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE, PERSONAL OR EMOTIONAL INJURY, INCLUDING DEATH THAT MAY BE SUSTAINED BY YOU AND YOUR GUESTS AS A RESULT OF USING THE POOL FACILITIES WHETHER THEY ARE SUPERVISED OR UNSUPERVISED.
You agree to be fully responsible for the day to day general safety conditions of the swimming pool at your rental property. This includes, but is not limited to, keeping the swimming pool clean of debris, keeping the swimming pool area clean, neat, and organized, keeping all gates and doors locked and the swimming pool area secured at all times, and operating the swimming pool in a safe and responsible manner.
Additional charges can be charged if the swimming pool in not kept clean and clear of debris and any foreign substance, which includes but is not limited to alcoholic beverages, food, bodily fluids, and excess sand or other debris.
Please note that there is absolutely no glass allowed in the pool or on pool deck/patio area, no exceptions. Any interruption or non-availability of the use of the swimming pool will not violate any terms of the rental agreement. The guests understand and agrees to allow the property management company access to maintain the pool and the pool equipment.
21. Video Surveillance: Video Surveillance in use to protect a property will be posted where applicable.
22. Elevator: Elevator is a convenience for guests use. Guests who tamper with or abuse the elevator equipment or controls or who create an unsafe environment for themselves or others in or around the elevator will be held responsible. Under no circumstance should anyone under the age of 16 be in the elevator without adult supervision. Any injury to an individual or damage to the elevator will be the responsibility of the renter. Do not allow children to jump while in the elevator. Elevators must not be used in the event of a fire or other emergency situations. The inner accordion door of the elevator must be closed upon entering, and after you exit, or it will not operate. Never cram into the elevator that is exceeding its capacity. If there is ever an issue with the elevator while inside use the ALARM or HELP button to call for assistance. Cell phones may work inside the elevator.
Please call the Property Manager or have someone call the Property Manager if there is an issue while inside the elevator. Your best course of action is to relax and wait for help. You may be inconvenienced but you are SAFE. Use only the stairs if there is a fire in the house or other situation that could lead to a disruption in electrical service. (Please also refer to the OPERATIONAL & SAFETY INSTRUCTIONS in the elevator.)
23. Law, Rules, and Regulations: Guests shall abide by all applicable local, state, and federal laws during their stay, as well as any rules and regulations of the property and the properties homeowner’s association. These rules apply to all guests. Failure to comply will result in eviction and forfeiture of all payments previously made along with any charges for damages.
24. Agent for Owner: Endless Summer on 30A, LLC serves as the agent/property manager for the owners of the rental property.
25. Limitation of Liability: You understand and agree that ENDLESS SUMMER ON 30A, LLC, ITS MEMBERS, EMPLOYEES, AGENTS, AND OWNERS OF THE HOME ASSUMES NO LIABILITY FOR LOSS, DAMAGE, CLAIM, OR INJURY TO ANY PERSONS OR THEIR PERSONAL PROPERTY WHILE ON THE PREMISES, NOR FOR ANY INCONVENIENCE, DAMAGE, CLAIM, LOSS, OR INJURY ARISING FROM OR RELATED TO ANY TEMPORARY DEFECTS OR STOPPAGE IN WATER SUPPLY, GAS, CABLE TV, INTERNET, ELECTRICITY, PLUMBING, AIR CONDITIONING/HEATING, APPLIANCES, AS WELL AS WEATHER CONDITIONS, NATURAL DISASTERS, ACTS OF GOD, OR ANY OTHER REASONS OUT OF OUR CONTROL. I UNDERSTAND THAT MY USE OF THE RENTAL HOME, INCLUDING THE RENTAL HOME, SWIMMING POOL, ELEVATOR, PARKING AREA, DRIVEWAY, ETC. AND RELEASE ALL LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT In consideration of the rental home.
I HEREBY AGREE AS FOLLOWS:
TO WAIVE ANY AND ALL CLAIMS THAT I HAVE OR MAY HAVE IN THE FUTURE HAVE AGAINST ENDLESS SUMMER ON 30A, LLC, ITS MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND THE HOME OWNERS, ANT TO RELEASE ANY AND ALL LIABILITY FOR ANY LOSS, DAMAGE, EXPENSE, OR INJURY INCLUDING DEATH THAT I MAY SUFFER, OR THAT MY NEXT OF KIN MAY SUFFER, RESULTING FROM OR ARISING OUT OF ANY ASPECTS MY USE AND GUESTS USE OF SAID RENTAL HOME, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, OR BREACH OF CONTRACT.
TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES FROM ANY AND ALL LIABILITY FROM ANY DAMAGE TO PROPERTY OF OR PERSONAL INJURY TO ANY THIRD PARTY, RESULTING FROM MY USE OF THE PROPERTY.
THIS AGREEMENT SHALL BE EFFECTIVE AND BINDING UPON MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRORS, AND REPRESENTATIVES, IN THE EVENT OF MY DEATH OR INCAPACITY.
THIS AGREEMENT AND ANY RIGHTS, DUTIES, AND OBLIGATIONS AS BETWEEN THE PARTIES TO THIS TERMS AND CONDITIONS-RENTAL AGREEMENT & POLICIES SHALL BE GOVERNED BY AND INTERPRETED SOLELY IN ACCORDANCE WITH THE LAWS OF THE STATE OF FLORIDA.
26. Concierge Rentals: RELEASE OF LIABILITY, WAIVER OF CLAIMS ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT WAIVING ALL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I accept full responsibility as renter for all family, guests, and myself for any of the equipment as well as all liabilities resulted from said equipment and agree to pay for any damages to the Equipment and replace the Equipment at the full retail value if damaged to such an extent that repairs are not feasible or practicable or if said equipment is lost or stolen. You also always agree to properly secure and lock bicycles to avoid theft, damage, or unauthorized use. Every bike comes with a lock to secure the bike at no additional charge.
I acknowledge that I have been advised to wear an approved helmet and/or protective gear while bicycling. I am aware that cycling is subject to all applicable Municipal and State traffic regulations including the use of a helmet. I am familiar with the proper use of the Equipment, including all quick release mechanisms, brakes and gear shifters. I am aware that there is staff available to answer any questions that I may have as to the proper use of the Equipment. I have made no representations regarding my cycling ability. Bicycles provided are not equipped with the required lighting to allow riding in the dark, so therefore no riding between sunset and sunrise is permitted. Parents and guardians are responsible for ensuring that minor children stay in compliance with all safety guidelines.
I am aware that quick release mechanisms, brakes, and other parts of the equipment might not function property all times. I am aware that riding involves risks, dangers and hazards including, but not limited to mechanical and structural failure of equipment, changing weather conditions, changes in terrain, difficulty, or inability to control one’s speed and direction, loss of balance, failure to cycle safely, or within one’s own ability, and negligence of other riders and NEGLIGENCE ON THE PART OF ENDLESS SUMMER ON 30A, LLC, ITS MEMBERS, EMPLOYEES, AGENTS, AND OWNERS OF THE HOME. I UNDERSTAND THAT MY USE OF THE EQUIPMENT, INCLUDING SAFETY EQUIPMENT, CANNOT GUARANTEE MY SAFETY OR FREEDOM FROM INJURY WHILE CYCLING. I AM AWARE THAT IT IS NOT POSSIBLE TO PREDICT EVERY CONDITION OR CIRCUMSTANCE UNDER WHICH THE EQUIPMENT AND SAFETY EQUIPMENT WILL NOT OPERATE AS INTENDED. I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS, AND HAZARDS, AND THE RESPONSIBILITY FOR PERSONAL INJURY, DEATH, PROPERTY DAMAGE, AND LOSS RESULTING THEREFROM.
I hereby agree as follows: To waive any and all claims that I have or may in the future have against ENDLESS SUMMER ON 30A, LLC, its members, directors, officers, employees, agents, and the home owners, and to release the releases from any and all liability for any loss, damage, expense or injury including death that I may suffer, or that my next of kin may suffer, resulting from or arising out of any aspects of my use of the Equipment, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, WARRANTY ON THE PART OF THE RELEASEES in respect of the design, manufacture, selection, installation, maintenance, inspection, service or repair of the Equipment, or in respect of the provision of or the failure to provide any warnings, direction, instructions or guidance as to the use of the Equipment. THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, CONCERNING THE RENTAL EQUIPMENT. I will return at once to the rental agent Endless Summer on 30A. LLC, any item(s) not functioning normally. I agree that I am responsible for correct use of rental items according to manufacturers’ instructions and guidelines.
Waiver of Liability: The rental agent Endless Summer on 30A, LLC is not responsible or liable for any negligence implied or otherwise, or personal injury, or death, or property loss, caused directly or indirectly in the use of the rented item(s). I confirm that I have read this agreement and voluntarily assume all risks of any damages occurring in connection with the item(s) in this rental agreement. I hereby agree for myself, my heirs, executors, administrators and assigns, to waive, release and discharge Endless Summer on 30A, LLC and their rental agents, servants, employees, agents, officers, directors, or representatives for any and all liability for any property damage, loss, personal injury, loss of life and/or other casualty which may occur during the course of this rental agreement and the use of the item(s), It is further understood and agreed that this waiver, release and assumption of risk is to be binding on my heirs, next of kin, executors, administrators, and assigns in the event of any death or injury.
Indemnification: Renter agrees to indemnify, defend, and hold Endless Summer on 30A, LLC and its agents, harmless from any claims, liabilities (including negligence, tort and strict liabilities), expenses, including reasonable attorney's fees, arising from or resulting from the manufacturer, possession, condition, use, operation, handling, transportation or return of the rented equipment.
Disclaimer of Warranties: Renter further acknowledges and agrees that Endless Summer on 30A, LLC is not the manufacturer or supplier of the rented equipment, Endless Summer on 30A, LLC is not required to enforce any manufacturer's warranties on behalf of itself of the renter, all item(s) rented are "as is" without any warranty, either express or implied, and the rental agent expressly disclaims any warranty, express or implied, including without limitation any warranty or merchantability for a particular purpose.
27. Travel Insurance: Vacation Rental Insurance has been made available with your reservation. Vacation Rental Insurance provides coverage for the loss of prepaid, non-refundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses. Trip Cancellation and Trip Interruption coverage is available for events such as a sickness or injury of yourself, family member or traveling companion; flight delays due to adverse weather; interruptions of road service; terrorist acts; and mandatory evacuations. The plan also includes other valuable coverages such as Medical and Dental, Baggage, and Emergency Assistance and Transportation in addition to useful services such as identity theft, concierge and 24/7/365 emergency assistance. We strongly recommend you purchase this valuable protection. 28. Damage Insurance: As a part of your stay, you may purchase a Vacation Rental Damage Protection plan designed to cover unintentional damages to the rental unit interior that occur during your stay provided they are disclosed to management prior to check-out. If purchased, the policy will pay a maximum benefit of $3000.00. Any damages that exceed $3000.00 or are not covered under the plan will be charged to the credit card on file. If, during your stay at one of our rental properties, an insured person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $3000.00. Certain terms and conditions apply. The Vacation Rental Damage Protection can be purchased up to, and including at, check-in. By submitting payment for this plan, you authorize and request Customized Services Administrators, Inc. d/b/a Generali Global Assistance & Insurance Services to pay directly Endless Summer on 30A, LLC any amount payable under the terms and conditions of the Vacation Rental Damage. Please contact Endless Summer on 30A, LLC directly if you do not wish to participate in this assignment.

You understand the property will be inspected prior to your arrival and after your departure.
You agree and give Endless Summer on 30A, LLC permission to charge the credit card on file for any damages, items missing, or additional cleaning for abnormally dirty unit/home that exceeds the security deposit or over the policy limit or not covered by the damage protection. There will be no additional charges if the following provisions are met. No damage is done to the property or its contents beyond normal wear and tear. No excessive cleaning is required. All keys, fobs, gate passes, and wristbands are left in the unit/home, and all entry/exit doors of the unit/home are left locked.
14. Hurricane/Severe Weather: Refunds for cancellations or shortened stays due to hurricanes, tropical storms, other inclement weather, or Acts of God will not be issued by Endless Summer on 30A, LLC under any circumstances. We recommend that all guests purchase adequate travel protection insurance.
15. Construction/Noise/Property for Sale during Stay: Properties adjacent to or close by the property being rented by the guest may have ongoing construction. Acceptable noise levels and start and finishing times are governed by local ordinances and/or the homeowners association. We are not liable for any disturbances or interruption that may occur during your stay that is out of our control. In the event a property is on the real estate market, we may need to show the property during your stay. We will provide the guests occupying the property 24 hours’ notice before scheduling any showings.
16. Departure: Prior to vacating the property, guests are responsible to remove all trash and put in garbage containers supplied. Any furniture that was moved during your visit must be put back in its original position. Dirty towels are to be left on the bathroom shower floors or in the bathtub. Please leave linens on the beds and do not make the beds that have been slept in. Reset thermostats to 74 degrees cool in hotter months and 64 degrees heat in colder months. Please check the property for your personal belongings before departing.
17. Liability: Owners and Property Managers shall not be liable to Guest, Guest’s guests, or any other person for any injury, including death, loss, or damage to any person or property on or about the premises. Guests shall hold Owner and Property Managers harmless and indemnified from and against all loss, injury, or damage caused by the use, misuse, or abuse of any part of the property, elevator, swimming pool, parking area, beach, and from or against any omission, neglect, or default of guests, guests guest, or invites. The Manager is also not responsible for any acts of theft, vandalism, or other damages to any personal property of the guests or for personal items left by the guests in the unit/home at departure.
18. Subletting: This property my not be sublet and is for the Guest’s use only. Your reservation is not transferable to any other party.
19. Property Rules & Regulations: Please observe all property rules including Operational & Safety Instructions for the elevator (instructions are in elevator), pool rules (rules are on fence in pool area), failure to comply can result in eviction and forfeiture of all payments previously made along with any additional charges for damages.
20. Swimming Pool: In consideration for receiving access and/or permission to use the swimming pool at your rental property or otherwise made available to you as an amenity in conjunction of your rental by Endless Summer on 30A, LLC, you herby release, waive, discharge, and covenant not to sue, and agree to indemnify and hold harmless for any and all purposes the Management Parties and Owners from any and all liabilities, claims, demands, responsibilities, causes of action or injury, including death, that may be sustained by you or your guests, involving or arising from you or your guests use of the pool and its facilities, or other actions or omissions related thereto, whether caused by the Manager Parties, Owners, or negligence.
You agree that you are fully aware that there are risks involved with use of the pool, including but not limited to possible physical injury and loss of life and you choose to voluntarily use the pool facilities with full knowledge that the use of the pool facilities may be hazardous to you and your guests.
YOU VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE, PERSONAL OR EMOTIONAL INJURY, INCLUDING DEATH THAT MAY BE SUSTAINED BY YOU AND YOUR GUESTS AS A RESULT OF USING THE POOL FACILITIES WHETHER THEY ARE SUPERVISED OR UNSUPERVISED.
You agree to be fully responsible for the day to day general safety conditions of the swimming pool at your rental property. This includes, but is not limited to, keeping the swimming pool clean of debris, keeping the swimming pool area clean, neat, and organized, keeping all gates and doors locked and the swimming pool area secured at all times, and operating the swimming pool in a safe and responsible manner.
Additional charges can be charged if the swimming pool in not kept clean and clear of debris and any foreign substance, which includes but is not limited to alcoholic beverages, food, bodily fluids, and excess sand or other debris.
Please note that there is absolutely no glass allowed in the pool or on pool deck/patio area, no exceptions. Any interruption or non-availability of the use of the swimming pool will not violate any terms of the rental agreement. The guests understand and agrees to allow the property management company access to maintain the pool and the pool equipment.
21. Video Surveillance: Video Surveillance in use to protect a property will be posted where applicable.
22. Elevator: Elevator is a convenience for guests use. Guests who tamper with or abuse the elevator equipment or controls or who create an unsafe environment for themselves or others in or around the elevator will be held responsible. Under no circumstance should anyone under the age of 16 be in the elevator without adult supervision. Any injury to an individual or damage to the elevator will be the responsibility of the renter. Do not allow children to jump while in the elevator. Elevators must not be used in the event of a fire or other emergency situations. The inner accordion door of the elevator must be closed upon entering, and after you exit, or it will not operate. Never cram into the elevator that is exceeding its capacity. If there is ever an issue with the elevator while inside use the ALARM or HELP button to call for assistance. Cell phones may work inside the elevator.
Please call the Property Manager or have someone call the Property Manager if there is an issue while inside the elevator. Your best course of action is to relax and wait for help. You may be inconvenienced but you are SAFE. Use only the stairs if there is a fire in the house or other situation that could lead to a disruption in electrical service. (Please also refer to the OPERATIONAL & SAFETY INSTRUCTIONS in the elevator.)
23. Law, Rules, and Regulations: Guests shall abide by all applicable local, state, and federal laws during their stay, as well as any rules and regulations of the property and the properties homeowner’s association. These rules apply to all guests. Failure to comply will result in eviction and forfeiture of all payments previously made along with any charges for damages.
24. Agent for Owner: Endless Summer on 30A, LLC serves as the agent/property manager for the owners of the rental property.
25. Limitation of Liability: You understand and agree that ENDLESS SUMMER ON 30A, LLC, ITS MEMBERS, EMPLOYEES, AGENTS, AND OWNERS OF THE HOME ASSUMES NO LIABILITY FOR LOSS, DAMAGE, CLAIM, OR INJURY TO ANY PERSONS OR THEIR PERSONAL PROPERTY WHILE ON THE PREMISES, NOR FOR ANY INCONVENIENCE, DAMAGE, CLAIM, LOSS, OR INJURY ARISING FROM OR RELATED TO ANY TEMPORARY DEFECTS OR STOPPAGE IN WATER SUPPLY, GAS, CABLE TV, INTERNET, ELECTRICITY, PLUMBING, AIR CONDITIONING/HEATING, APPLIANCES, AS WELL AS WEATHER CONDITIONS, NATURAL DISASTERS, ACTS OF GOD, OR ANY OTHER REASONS OUT OF OUR CONTROL. I UNDERSTAND THAT MY USE OF THE RENTAL HOME, INCLUDING THE RENTAL HOME, SWIMMING POOL, ELEVATOR, PARKING AREA, DRIVEWAY, ETC. AND RELEASE ALL LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT In consideration of the rental home.
I HEREBY AGREE AS FOLLOWS:
TO WAIVE ANY AND ALL CLAIMS THAT I HAVE OR MAY HAVE IN THE FUTURE HAVE AGAINST ENDLESS SUMMER ON 30A, LLC, ITS MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND THE HOME OWNERS, ANT TO RELEASE ANY AND ALL LIABILITY FOR ANY LOSS, DAMAGE, EXPENSE, OR INJURY INCLUDING DEATH THAT I MAY SUFFER, OR THAT MY NEXT OF KIN MAY SUFFER, RESULTING FROM OR ARISING OUT OF ANY ASPECTS MY USE AND GUESTS USE OF SAID RENTAL HOME, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, OR BREACH OF CONTRACT.
TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES FROM ANY AND ALL LIABILITY FROM ANY DAMAGE TO PROPERTY OF OR PERSONAL INJURY TO ANY THIRD PARTY, RESULTING FROM MY USE OF THE PROPERTY.
THIS AGREEMENT SHALL BE EFFECTIVE AND BINDING UPON MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRORS, AND REPRESENTATIVES, IN THE EVENT OF MY DEATH OR INCAPACITY.
THIS AGREEMENT AND ANY RIGHTS, DUTIES, AND OBLIGATIONS AS BETWEEN THE PARTIES TO THIS TERMS AND CONDITIONS-RENTAL AGREEMENT & POLICIES SHALL BE GOVERNED BY AND INTERPRETED SOLELY IN ACCORDANCE WITH THE LAWS OF THE STATE OF FLORIDA.
26. Concierge Rentals: RELEASE OF LIABILITY, WAIVER OF CLAIMS ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT WAIVING ALL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I accept full responsibility as renter for all family, guests, and myself for any of the equipment as well as all liabilities resulted from said equipment and agree to pay for any damages to the Equipment and replace the Equipment at the full retail value if damaged to such an extent that repairs are not feasible or practicable or if said equipment is lost or stolen. You also always agree to properly secure and lock bicycles to avoid theft, damage, or unauthorized use. Every bike comes with a lock to secure the bike at no additional charge.
I acknowledge that I have been advised to wear an approved helmet and/or protective gear while bicycling. I am aware that cycling is subject to all applicable Municipal and State traffic regulations including the use of a helmet. I am familiar with the proper use of the Equipment, including all quick release mechanisms, brakes and gear shifters. I am aware that there is staff available to answer any questions that I may have as to the proper use of the Equipment. I have made no representations regarding my cycling ability. Bicycles provided are not equipped with the required lighting to allow riding in the dark, so therefore no riding between sunset and sunrise is permitted. Parents and guardians are responsible for ensuring that minor children stay in compliance with all safety guidelines.
I am aware that quick release mechanisms, brakes, and other parts of the equipment might not function property all times. I am aware that riding involves risks, dangers and hazards including, but not limited to mechanical and structural failure of equipment, changing weather conditions, changes in terrain, difficulty, or inability to control one’s speed and direction, loss of balance, failure to cycle safely, or within one’s own ability, and negligence of other riders and NEGLIGENCE ON THE PART OF ENDLESS SUMMER ON 30A, LLC, ITS MEMBERS, EMPLOYEES, AGENTS, AND OWNERS OF THE HOME. I UNDERSTAND THAT MY USE OF THE EQUIPMENT, INCLUDING SAFETY EQUIPMENT, CANNOT GUARANTEE MY SAFETY OR FREEDOM FROM INJURY WHILE CYCLING. I AM AWARE THAT IT IS NOT POSSIBLE TO PREDICT EVERY CONDITION OR CIRCUMSTANCE UNDER WHICH THE EQUIPMENT AND SAFETY EQUIPMENT WILL NOT OPERATE AS INTENDED. I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS, AND HAZARDS, AND THE RESPONSIBILITY FOR PERSONAL INJURY, DEATH, PROPERTY DAMAGE, AND LOSS RESULTING THEREFROM.
I hereby agree as follows: To waive any and all claims that I have or may in the future have against ENDLESS SUMMER ON 30A, LLC, its members, directors, officers, employees, agents, and the home owners, and to release the releases from any and all liability for any loss, damage, expense or injury including death that I may suffer, or that my next of kin may suffer, resulting from or arising out of any aspects of my use of the Equipment, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, WARRANTY ON THE PART OF THE RELEASEES in respect of the design, manufacture, selection, installation, maintenance, inspection, service or repair of the Equipment, or in respect of the provision of or the failure to provide any warnings, direction, instructions or guidance as to the use of the Equipment. THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, CONCERNING THE RENTAL EQUIPMENT. I will return at once to the rental agent Endless Summer on 30A. LLC, any item(s) not functioning normally. I agree that I am responsible for correct use of rental items according to manufacturers’ instructions and guidelines.
Waiver of Liability: The rental agent Endless Summer on 30A, LLC is not responsible or liable for any negligence implied or otherwise, or personal injury, or death, or property loss, caused directly or indirectly in the use of the rented item(s). I confirm that I have read this agreement and voluntarily assume all risks of any damages occurring in connection with the item(s) in this rental agreement. I hereby agree for myself, my heirs, executors, administrators and assigns, to waive, release and discharge Endless Summer on 30A, LLC and their rental agents, servants, employees, agents, officers, directors, or representatives for any and all liability for any property damage, loss, personal injury, loss of life and/or other casualty which may occur during the course of this rental agreement and the use of the item(s), It is further understood and agreed that this waiver, release and assumption of risk is to be binding on my heirs, next of kin, executors, administrators, and assigns in the event of any death or injury.
Indemnification: Renter agrees to indemnify, defend, and hold Endless Summer on 30A, LLC and its agents, harmless from any claims, liabilities (including negligence, tort and strict liabilities), expenses, including reasonable attorney's fees, arising from or resulting from the manufacturer, possession, condition, use, operation, handling, transportation or return of the rented equipment.
Disclaimer of Warranties: Renter further acknowledges and agrees that Endless Summer on 30A, LLC is not the manufacturer or supplier of the rented equipment, Endless Summer on 30A, LLC is not required to enforce any manufacturer's warranties on behalf of itself of the renter, all item(s) rented are "as is" without any warranty, either express or implied, and the rental agent expressly disclaims any warranty, express or implied, including without limitation any warranty or merchantability for a particular purpose.
27. Travel Insurance: Vacation Rental Insurance has been made available with your reservation. Vacation Rental Insurance provides coverage for the loss of prepaid, non-refundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses. Trip Cancellation and Trip Interruption coverage is available for events such as a sickness or injury of yourself, family member or traveling companion; flight delays due to adverse weather; interruptions of road service; terrorist acts; and mandatory evacuations. The plan also includes other valuable coverages such as Medical and Dental, Baggage, and Emergency Assistance and Transportation in addition to useful services such as identity theft, concierge and 24/7/365 emergency assistance. 28. Damage Insurance: As a part of your stay, you may purchase a Vacation Rental Damage Protection plan designed to cover unintentional damages to the rental unit interior that occur during your stay provided they are disclosed to management prior to check-out. If purchased, the policy will pay a maximum benefit of $3000.00. Any damages that exceed $3000.00 or are not covered under the plan will be charged to the credit card on file. If, during your stay at one of our rental properties, an insured person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $3000.00. Certain terms and conditions apply.
